The organizer of the Formula 1 Vegas Prix 2023 ("Event") is LAS VEGAS GRAND PRIX, INC. ("Promoter"). Each ticket for the Event, held at the Las Vegas Strip Circuit ("Circuit"), serves as a revocable license allowing entry to the Circuit grounds and a designated seat or standing area (as indicated on the ticket) for the Event. By seeking entry using such license, and including any accompanying minors, the person ("Holder") agrees to abide by these terms and conditions, which include any referenced documents, as amended or supplemented by the Promoter ("Terms and Conditions"). Through the purchase, acceptance, and/or use of the license, the Holder is considered to have read and agreed to the Terms and Conditions. Non-compliance with these Terms and Conditions may result in the forfeiture of the license and all associated rights without refund, allowing the Promoter, Formula One World Championship Limited ("FOWC"), Formula One Marketing Limited ("FOML"), and their affiliates to pursue necessary legal action. The Promoter reserves the sole discretion to refuse admission, revoke entry, or eject the Holder for any reason.
ALL TICKET SALES ARE FINAL, and there will be no refunds or exchanges unless stated otherwise. The only remedy available if admission is wrongfully refused or revoked, if capacity limits lead to ticket cancellation, or if the Event is canceled without a rescheduled date, is a refund of the ticket's Face Value, which is the amount set by the Promoter. The maximum liability of the Promoter for any breach of the Terms and Conditions is limited to the Face Value. PROMOTER, FOWC, and any affiliated parties shall not be held liable for any special, consequential, incidental, indirect, or exemplary damages of any kind, regardless of foreseeability, including any amount paid beyond the Face Value of the ticket. Any dispute or claim related to the ticket or the Event shall be resolved through mandatory, confidential, final, and binding arbitration conducted by JAMS in Las Vegas, Nevada, following their Streamlined Rules. All disputes shall be arbitrated on an individual basis, applying the substantive laws of Nevada. The Holder acknowledges that they are waiving their right to a court or jury trial and any right to assert a claim as a class action, representative action, or class arbitration. If the Holder does not agree to this clause, they must leave or refrain from entering the Circuit grounds. This clause is governed by the Federal Arbitration Act.
Tickets for the Event are strictly non-transferable and cannot be resold unless authorized by the Promoter. Only authorized agents can sell tickets, and tickets from unauthorized sources will not be accepted. If a ticket is resold or transferred for profit without permission, it becomes void and the Holder may be denied entry or ejected from the Circuit grounds. Illegible tickets are also void. Tickets cannot be used for commercial purposes without the written consent of the Promoter.
The Promoter, FIA, FOWC, or their affiliates do not guarantee that the Event will take place as scheduled on the ticket. Event dates and times are subject to change at the Promoter's discretion, and such changes do not entitle the Holder to a refund or remedy. There are no refunds for delays, interruptions, or incomplete sessions or days of the Event. The Holder may be relocated at the Promoter's discretion, but such relocation does not entitle the Holder to a refund unless the new location has a significantly lower Face Value, in which case an equitable adjustment will be provided.
HOLDER AGREES THAT MOTOR RACING, THE EVENT, AND CERTAIN ACTIVITIES ASSOCIATED WITH THE EVENT (including, without limitation, SUPPORT Races AND OTHER RELATED EVENTS) ARE DANGEROUS AND HOLDER AGREES TO ATTEND AT THEIR OWN RISK AND VOLUNTARILY ASSUMES ALL RISKS, HAZARDS, AND DANGERS incidental to the Event and related events, including, without limitation, the risk of injury(including death, paralysis, head or another bodily injury, broken bones or burns), exposure to noxious chemicals and gases (including automotive exhaust or smoke from automotive fires), damage to hearing from loud noises (including automotive noise, crowd noise, and loud music), exposure to communicable diseases, viruses, bacteria or illnesses or the causes thereof, or lost, stolen or damaged property, whether occurring before, during, or after the Event, however, caused.
